Please read these terms carefully before using our services

These Terms and Conditions ("Terms") govern the access to and use of the services provided by Win-Win Hiring, operated by Mr Job LLC("Win-Win Hiring," "Company," "we," "us," or "our").

​

By accessing our website, submitting information, communicating with us, or using our services in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our services.

1. NATURE OF SERVICES

Win-Win Hiring is a women-only, flat-fee recruitment and placement service that facilitates introductions between employers and candidates.

Win-Win Hiring acts solely as an intermediary, referral service, and matchmaker. Win-Win Hiring is not an employer, not a staffing agency, and not a party to any employment, contractor, or consulting relationship unless expressly agreed to in writing.

2. NO EMPLOYMENT RELATIONSHIP

Win-Win Hiring does not:

​

  • Employ, supervise, manage, or control candidates

  • Control compensation, schedules, benefits, job duties, or workplace conditions

  • Participate in hiring, discipline, evaluation, or termination decisions

​

All employment or engagement relationships are exclusively between the employer and the candidate.

3. NO RESPONSIBILITY FOR EMPLOYER–CANDIDATE RELATIONSHIP

To the maximum extent permitted by law, Win-Win Hiring disclaims all responsibility and liability arising from or related to any relationship, interaction, or dispute between an employer and a candidate.

This includes, without limitation, claims relating to:

​

  • Hiring or termination decisions

  • Workplace conduct, supervision, or safety

  • Harassment, discrimination, retaliation, or hostile work environment

  • Wage, overtime, benefits, or compensation disputes

  • Breach of contract or wrongful termination

  • Negligence, misconduct, fraud, or dishonesty

  • Emotional distress, reputational harm, or business losses

4. NO RESPONSIBILITY FOR HARM OR DAMAGES

Win-Win Hiring shall not be liable for any damages of any kind, including but not limited to:

  • Physical injury or bodily harm

  • Emotional or psychological distress

  • Financial or economic loss

  • Reputational or business damage

  • Property damage

whether direct, indirect, incidental, consequential, punitive, or exemplary, even if foreseeable.

5. NO VERIFICATION OR GUARANTEES

Win-Win Hiring may rely on information provided by employers and candidates and does not independently verify:

​

  • Accuracy or completeness of resumes or statements

  • Credentials, licenses, or certifications

  • Criminal background or history

  • Work authorization or immigration status

  • Past performance or conduct

  • Employers are solely responsible for conducting all legally required background checks and compliance reviews.

6. NO FINANCIAL ADVICE

Win-Win Hiring does not provide financial, investment, tax, accounting, insurance, or compensation advice.

Any discussions regarding compensation, benefits, or business decisions are provided solely for general informational purposes and shall not be relied upon as professional advice.

7. NO LEGAL ADVICE; NO LEGAL INVOLVEMENT

Win-Win Hiring does not provide legal advice and does not represent any employer or candidate in any legal capacity.

Win-Win Hiring shall not be responsible for, nor participate in, any legal matter, including but not limited to:

​

  • Employment or labor law disputes

  • Contractual disputes

  • Government audits or investigations

  • Regulatory compliance matters

  • Litigation, arbitration, or mediation

​

Each party is solely responsible for retaining its own legal counsel.

8. NO RELIANCE

You expressly acknowledge that:

​

  • You are not relying on Win-Win Hiring for legal, financial, or professional advice

  • All decisions are made based on your independent judgment

  • Win-Win Hiring shall not be liable for outcomes resulting from reliance on any information provided

9. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Win-Win Hiring, Mr Job LLC, and their owners, officers, employees, and affiliates from any and all claims, liabilities, damages, losses, costs, and expenses (including attorneys' fees) arising from or related to:

  • The employment or engagement of any candidate

  • Any act or omission of an employer or candidate

  • Any workplace incident or dispute

  • Any violation of law or contract

10. GOVERNING PRINCIPLES: JEWISH LAW FIRST; NEW YORK LAW SECOND

10.1 Primary Governing Framework

To the fullest extent permitted by law, all matters arising out of or relating to these Terms or the services provided shall be governed first and foremost by Jewish Law (Halacha).

10.2 Halachic Resolution Requirement

Prior to initiating arbitration or court proceedings, the parties agree to make a good-faith effort to resolve disputes in accordance with Halacha, including submission to a mutually agreed-upon Beit Din, where applicable and legally permissible.

​

10.3 Secondary Governing Law

Where secular enforcement is required, disputes shall be governed by the laws of the State of New York, without regard to conflict-of-law principles.

This section is intended to supplement, not invalidate, the arbitration and venue provisions below.

11. MANDATORY BINDING ARBITRATION

Any dispute, claim, or controversy arising out of or relating to these Terms or the services provided shall be resolved exclusively by final and binding arbitration, conducted on an individual basis only, in accordance with the rules of the American Arbitration Association (AAA).

12. CLASS ACTION AND COLLECTIVE ACTION WAIVER

To the fullest extent permitted by law:

​

  • All claims must be brought on an individual basis only

  • You waive any right to participate in a class, collective, representative, or private attorney general action

  • The arbitrator shall have no authority to hear or decide any such claims

13. WAIVER OF JURY TRIAL

YOU AND WIN-WIN HIRING IRREVOCABLY WAIVE ANY RIGHT TO A JURY TRIAL.

14. EXCLUSIVE NEW YORK VENUE

If arbitration is determined to be unenforceable for any reason, any legal action shall be brought exclusively in the state or federal courts located in the State of New York, and you irrevocably consent to such jurisdiction and venue.

15. STATUTE OF LIMITATIONS

Any claim must be filed within one (1) year of the event giving rise to the claim or shall be permanently barred.

16. SEVERABILITY

If any provision is held unenforceable, the remaining provisions shall remain in full force and effect.

17. SURVIVAL

All provisions relating to liability, indemnification, arbitration, governing law, and venue shall survive termination of services.

18. ENTIRE AGREEMENT

These Terms constitute the entire agreement between the parties and supersede all prior communications or understandings.
